Trial starts for alleged Palace brawl instigator

John Green, the man accused of starting the infamous Piston-Pacer Brawl in November 2004, began his trial on Friday. He is charged with misdemeanor assault and battery.

Green's attorney is arguing that tossing a cup is not assault. I wonder if he's saying that it's illegal, just not "assault", or that it's perfectly legal.
