The wrath of Roger Goodell

Last time I checked, this is America, the land of the free. The land where all criminals from jaywalkers to murderers are given their day in court. They are innocent until proven guilty. People don't get punished unless they are found guilty by a jury of their peers.

Unfortunately, though, that doesn’t hold true in the court of public opinion where only an accusation is needed to brand someone for the rest of his life.

You only have to look back at the last sports-related criminal accusation, the debacle that was the Duke men’s lacrosse rape case. In the court of public opinion, those three men were tried and convicted of raping a stripper at a party. But finally, almost two years later, the real court ran its course and found out that they did nothing wrong. Those men lost a year of their lives and who knows how much else as a result of one woman’s pettiness. An entire nation was too eager to jump to conclusions and didn't bother waiting until all the facts and evidence were presented.

So is the case for Michael Vick. Vick, according to a federal indictment, has ties to a dog fighting ring operated out of a house he owns in Virginia. But did he engage in said fights? Did he fund the Bad Newz Kennels? Was he even aware that it was going on at the property?

Maybe. But Maybe not.

Therein lies the problem with Commissioner Roger Goodell’s “suspension” of Michael Vick. Now, Goodell hasn’t really suspended Vick, but he has ordered him not to report to the Falcons’ training camp. And you’d have to be a halfwit not to know that a lengthy suspension is coming for Vick. And coming before he’s tried or (maybe) proven guilty in court.

Goodell is going to determine the future of Vick’s career in the NFL, but there is no specific timetable for that decision. Except that it will happen "as soon as possible".

"While it is for the criminal justice system to determine your guilt or innocence, it is my responsibility as commissioner of the National Football League to determine whether your conduct, even if not criminal, nonetheless violated league policies, including the personal conduct policy," Goodell wrote Vick in a letter, according to an NFL statement.

So, the question is, exactly what part of the personal conduct policy did Vick violate? Unfortunately for guys like Vick, Pacman Jones and Chris Henry, Goodell has the power of interpretation. He can use the now very strict personal conduct policy to determine a case as he sees fit.

Under the persons charged with criminal activity heading of the conduct policy, which it would seem applies to Vick at this point (even though he hasn't even been charged yet), it states:

“Any Covered Person arrested for or charged with conduct prohibited by this policy will be required to undergo an immediate, mandatory clinical evaluation and, if directed, appropriate counseling.”

But that’s not what has, or will, happen to Vick. He is going to be suspended and lose a lot of money as a result of this accusation, or maybe, only as a result of him associating himself with the wrong people. But Goodell, or any policer of an organization, has no right to determine who a person hangs out with outside of work.

Now, let’s make this perfectly clear. I in no way condone, support or engage in electrocuting, hanging or beating dogs to death, or dog fighting in general for that matter. But Vick is going to be a victim of Goodell’s wrath.

The difference between Jones and Vick is that Vick isn’t an idiot. He doesn’t feel the need to make it rain at a strip club the night before he’s due to meet with Goodell to discuss his actions. Vick has generally been a stand-up guy since he left Blacksburg for Atlanta.

Goodell had to make a statement with the Jones incident. And he did. But now it should be interesting to see what he does with Vick, a money-making machine for the NFL. And if Jones was suspended for an entire season, the same likely will happen to Vick.

But Goodell, while he should be commended for trying to clean up the NFL, oversteps his boundaries. Whether or not Vick is convicted of these crimes, his life is going to change significantly. And change for the worse. The amount of money he is going to lose over this incident, thanks to organizations like PETA, is immeasurable.

Atlanta Falcons owner Arthur Blank can do what he wants with Vick, he signs the checks. But Goodell shouldn't decide Vick's future until he's proven to have committed the crime. He has no right to decide how the Falcons should handle the situation until then. But unfortunately that’s exactly what he’s going to do.

The evidence against Vick is so damning...it's not like the Duke case where race issues caused 3 white men to be on the wrong side of a racial tirade (for a change). Regardles, I think the issue shouldn't be about ethics or the judicial system...Vick did something wrong, period...everyone knows that we all get our day in court...The problem is that Roger Godell was showing some favoritism toward a star player by not handing down swift suspensions like he did for the other knuckleheads in this league...the problem here is consistency in handing down punishment...

The whole point is that you DON'T know Vick did something wrong. Where is this damning evidence you speak of? It is nothing but allegations and allegations are often very wrong. And it took a lot longer than a week for Goodell to suspend Pacman.

You're aware that the NFL and the court of law are not the same thing...

Precedence in NFL personal conduct policies, set by goodell have already suggested that Goodell doesn't care about the wheels of justice...

and federal indictment to conviction rates...95%?

It is the difference between what the government can do to you and what your employer can do. Since I live in an "at will" employment state, my employer could fire me tomorrow for *any* reason they see fit. (other than those protected by law: race, religion, disability etc). If my face was plastered all over the local papers tomorrow because I ran an illegal dogfighting ring, mentioning where I worked, I and most others in that situation could easily be fired just for the bad publicity. Don't act like Vick is being 'singled out' because he is an NFL player, he is being treated quite special, he is still being paid (for doing nothing) and still has his job.

The Duke and Vick cases are completely different. The court of public opinion damned the accused in both cases, but that's the only similarity. In the Duke case, there was virtually no evidence and the DA was a douchebag who wanted to get re-elected. In the Vick case, the amount of hard evidence in the indictment is staggering, and a DA is not indicting, the feds are. The feds would not have indicted him if they didn't think Vick was guilty.

Are you people reading the story? Meg, that WAS the only similarity I was suggesting in the article. The cases aren't the same except that each has been judged before finding out everything. And it's not the hard evidence that is the point, there was obviously dog fighting going on at the property. What we know now is only the tip of the iceberg. In time we will know everything and then judgments can be made. The question is whether or not Vick had any knowledge or involvement in it. That is what Roger Goodell doesn't know yet.

I read the story...

I also read the indictment...

Having a problem with the NFL's interpretation of their personal conduct policy is fine...i completely see your point...but not going after vick, after seeing the chris Henrys, tank johnsons and pacman jones feel the pain is...the essence of a double standard...something Goodell doesn't want...or at least he wants to prove doesn't exist...

Austin...first of all, take it easy...no need to get all wriled up over this...it's all opinion and it's supposed to be FUN... Second, PLEASE read the indictment...there are several accounts of witnesses who placed Vick AT THE DOG FIGHTS...they found 18 (i think) dogs buried on HIS property...and don't spoonfeed me more BS by saying that he wasn't there...you have to be smarter that that...if you own the property, you better damn well know whats going on there...even if you are "lookin out for ya boys"

I can say that it was you that was there, and not Vick, and you'd get your behind in the same sling as him, too. There's been no testimony that proves or disproves the truthfulness of those "witnesses", who could be babbling to keep themselves out of prison or just flat out making it up as they go along.

There are a lot of reasons these cases are different. The biggest reason, though, is that the NFL is a business, and as such, they can do things to protect their business interests. If the CEO of Coca-Cola were indicted for the same charges, he could and would be removed by the Board of Directors. They wouldn't wait for the trial to protect their image, their product, and their revenues. That CEO--and Vick, for that matter--could try to seek damages in civil court, but the fact of the matter is that Vick has done damage to his employers product. I think they are perfectly within their rights to release or suspend him to protect the NFL.

I completely agree with you about the CEO and the board of directors thing, but it's a different game. There is a business (the Falcons) within a business (the NFL) here and Goodell oversteps his boundaries in what should be Arthur Blank's decision. But only his for now, obviously.

How can you possibly say it's Arthur Blank's decision? He's the commissioner of the entire league...meaning, he oversees and and all operations...are you saying it was the responsibility of Bud Adams, Virginia McCaskey, and Mike Brown to suspend Pacman, Tank, and Chris Henry? Of course not...Godell is the man who oversees all of the businesses within his own business and he has every right to control it...

You can't compare Pacman, Henry and Tank to Vick because they were arrested and charged. When that happens to Vick, then yes, Goodell can do what he wants. But until that happens it shouldn't be his jurisdiction. Despite how bad it looks for Vick, and what the indictment to conviction rate is, nothing has been proven, and he really hasn't done anything punishable. Yet.

Well, you're actually incorrect, in that its Goodell's decision, as he is the league's governing body leader...furthermore, Blank only has the ability to suspend him for 4 games and that's subject to review by the NFLPA...if Goodell suspends Vick (he did), the only person who can overturn that ruling is...Roger Goodell...

So, perhaps they worked together, but Goodell is the work around in avoid any NFLPA disputes...

If your concern is with a conviction, then Pacman, Johnson and Henry have the world to do with it because none of them were suspended (at the time) for convictions...only charges. That, would be precedence.

Maybe...He's working towards consistancy...its hard when you get a high profile case like this...

If you issues are with it being high profile, or a singular incident or another disimilar factor to the aforementioned trio, I'll accept that...

But Goodell has been consistant in being ahead of convictions...

The NFL is a business consisting of franchises. Each franchise must adhere to league policy. That policy is governed by a collective bargaining agreement. Whether one likes it or not, this business known collectively as the NFL has agreed to permit its commisioner these absolute powers to suspend players for behavior "inconsistent" with league policy. Therefore, it is not up to Arthur Blank to determine the fate of Michael Vick's playing career at this present time. It is up to Roger Goodell.

Look just to clarify...my problem with this whole thing is consistency...it's like being a coach or a parent...you have to be consistent in your punishment...Godell wasn't consistent...and yeah, Pacman wasn't suspended within the week because his first incident was rather minor compared to the past two, especially the one that left a man paralyzed

To that extent, we've all made transgressions...

I think tyrone's point is that Vick has really done little in the legal world to cause trouble. He had the whole ron mexico "i've got the herpe" thing...He had the waterbottle incident, which resulted in nothing and he did give falcons fans the finger...which cost him 20k, 10 in a fine and 10 to charity...

Were those stupid...yes...we're they pacmanian in level? I'd say no

"innocent until proven guilty" applies to the government's ability to put you in jail. An employer can fire you for nothing or anything in most states (unless there is a contract or an issue like race/gender/etc). I believe the NFL not only had the right to punish Vick for the indictment, but has a responsibility to it's fans and employees to investigate on their own and act accordingly, independent of the criminal justice system.

Vick will never be proved innocent by the criminal justice system. At most he will be proved "not guilty." It's not the same thing. the NFL has to determine whether he actually did it. The criminal justice system may never demonstrate that at all.

Plus, I think the NFL is well within their rights to punish players by revoking the privilege of playing in that league even if all they did was bring negative attention to the league. The NFL is a private organization, not the government. Whether or not America is a "free country" whatever that means, part of that means that an employer has some freedom to protect his or her investment in the way he or she chooses.

Let me just share how very happy I am to be living in Richmond Virginia, where Vick's court appearances will be held. [/sarcasm]

Honestly. Vick is just DONE. Every dog lover in America is going to pick Fido over Vick for the rest of forever, and that's a LOT of dog owners. To hell with "Innocent until proven guilty." Goodell has to disassociate this sadistic behavior from the league which has entrusted its financial and public-relations health to him, and getting Vick the hell away from the practice field is the least he can do. I'm surprised it took as long for the commissioner to act as it did.

Goodell IS treating Vick differently than Henry, Jones and Johnson. If it was one of them under this indictment, their asses would be already on the street.
