As I cruised all the sports pages on-line today I ran across this... http://www.msnbc.msn.com/id/20256509/

Apparently Barry Bonds is tired of people commenting about him and what he may or may not have done. So he has decided to seek council and look at options to sue people for defamation.

According to a report by InsideBayArea.com, the web site for the Oakland Tribune, the new home run king has hired two lawyers to go after and punish those that make false statements about him.

Could Barry Bonds and his story get any more bizarre...

More to come I am sure.

Public figures are suseptable to scrutiny...if anything is false and/or slanderous, he may have a case, but overall, it would seem that most items written about bonds were either based on fact or speculation for the future (from whenever it was written)...moreover, stating items such as, "He's a jerk" are probably ok, but only because he is such a public and visable person... Besides, if this were a feasable option, wouldn't the likes of britney spears and lindsay lohan have successfully sued numerous folks by now...

I agree people are susceptible to scrutiny but there are some media personnel that are condemning him before he's be convicted of the crime. Regardless of what we know, he still hasn't confessed to anything and making that assumption out loud is still considered slander and if it's written, libel. I agree he's a jerk but we still owe the "jerk" some respect especially if it turns out that he's innocent of the charges. Where does that leave us if he is?

I quick scan of expertlaw.com suggests otherwise:

"A defense similar to opinion is "fair comment on a matter of public interest". If the mayor of a town is involved in a corruption scandal, expressing the opinion that you believe the allegations are true is not likely to support a cause of action for defamation. "

and with respect to public figures:

"Under the First Amendment of the United States Constitution, as set forth by the U.S. Supreme Court in the 1964 Case, New York Times v Sullivan, where a public figure attempts to bring an action for defamation, the public figure must prove an additional element: That the statement was made with "actual malice". In translation, that means that the person making the statement knew the statement to be false, or issued the statement with reckless disregard as to its truth. For example, Ariel Sharon sued Time Magazine over allegations of his conduct relating to the massacres at the Sabra and Shatila refugee camps. Although the jury concluded that the Time story included false allegations, they found that Time had not acted with "actual malice" and did not award any damages. "

It is not defamation if the subject matter is the truth. So Bonds is up a creek without a paddle.

Good luck. Generate a lot of headlines and have lawyers and staffs actively digging for info on Barry etc and presenting it in a court of law. If he is clean, not a problem, if not, well egg all over his face....

Bonds is wasting his time and money on this. He still is not filing suit against those armed with facts like the Game of Shadows authors. Looks like it is more a case of him wanting to prosecute writers twisting his words around. To me it is like an admission of guilt that he doesn't prosecute the Game of Shadows authors.
